Agreement and scope

These Terms cover www.traxau.com, app.traxau.com and any TRAXAU feature, workspace, report, communication or service that links to them. Additional feature-specific terms may apply. If they conflict, the more specific terms govern that feature.

If you use TRAXAU for an organisation, you confirm that you have authority to bind it. “You” then includes that organisation.

Eligibility and supported location

You must be at least 18, legally capable of entering a contract, and permitted to use the services under laws that apply to you. TRAXAU is initially offered as a supported service in Singapore only. Access from elsewhere does not mean we offer or approve the service there.

You must not use TRAXAU from a sanctioned, embargoed, prohibited or otherwise unsupported location, or if local law prohibits your use. We may use location and account information to apply jurisdiction controls.

What TRAXAU provides

TRAXAU provides software tools for self-directed XAU/USD traders to document their own trade ideas, test them against their own rules, review scenarios, maintain a journal and analyse their process. A.G.O.R.A., S.A.G.E.S. and other automated features may organise information or produce model-generated observations from your inputs.

Features, plans and limits may change as the service develops. We will give reasonable notice of material changes where required.

Trading risk and no advice

Trading leveraged products, commodities, foreign exchange and gold-related instruments can result in rapid and substantial loss, including loss beyond an initial deposit where a broker permits it. Past performance and modelled scenarios do not predict future results.

TRAXAU does not recommend whether, when or how you should trade; provide personalised investment, financial, legal or tax advice; issue trading signals; execute or route orders; hold money or assets; monitor a brokerage account for you; or guarantee any outcome. Outputs may be incomplete, delayed, inaccurate or unsuitable for your circumstances. You alone decide whether to trade and are responsible for independent checks, position sizing and compliance with broker and legal requirements.

Your account and information

Provide accurate, current information and keep your credentials confidential. You are responsible for activity under your account unless caused by our breach of duty. Notify us promptly if you suspect unauthorised access.

You retain ownership of your trade plans, journal entries and other material you submit (“User Content”). You grant us a limited, non-exclusive licence to host, copy, process and display User Content only as needed to operate, secure and improve the service, comply with law, and fulfil your requests, in line with our Privacy Policy.

Acceptable use

You must not break the law; infringe rights; upload malware; probe or bypass security or jurisdiction controls; scrape or overload the service; reverse engineer except where law expressly permits; share, sell or transfer account access; impersonate others; submit information you lack authority to use; or use outputs to create a competing dataset or service.

Do not enter broker passwords, API secrets, private keys, seed phrases, full payment-card details or unrelated sensitive personal data into ordinary forms or journals.

TRAXAU content and intellectual property

TRAXAU and its licensors own the service, software, design, branding, documentation and content we provide, excluding User Content. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the service for your internal personal or business purposes during your plan.

Feedback may be used without restriction or payment, but we will handle personal data within it under our Privacy Policy.

Trials, subscriptions and payment

Prices, billing intervals, taxes, included features and any trial period are shown before purchase. Paid plans renew automatically at the disclosed interval until cancelled. You authorise our payment provider to charge the payment method on file. We will not use pre-ticked boxes or obscure recurring charges.

You can cancel before the next renewal through the account controls or by contacting us. Cancellation prevents future renewal and normally leaves access available until the end of the paid term. Refunds are governed by our Refund Policy, including the voluntary 14-day first-payment guarantee and any non-excludable statutory rights.

Third-party services

TRAXAU may link to or interoperate with brokers, market-data sources, payment providers or other independent services. We do not control them and are not responsible for their availability, accuracy, security or terms. Enabling an integration authorises us to exchange the information described at connection time. Your agreement with the third party remains separate.

Availability and changes

We aim to operate TRAXAU reliably but do not promise uninterrupted or error-free access. Maintenance, security events, provider outages, market-data delays and circumstances beyond reasonable control may affect the service. We may modify, suspend or discontinue a feature and will give reasonable notice when a material paid feature is discontinued, where practicable and required.

Disclaimers and limits

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Nothing in these Terms excludes a warranty, remedy or liability that law does not permit us to exclude.

To the fullest extent permitted by law, TRAXAU is not liable for trading losses, lost profits, lost opportunity, loss of data, or indirect, special, incidental, exemplary or consequential loss arising from use of or inability to use the service. Our total aggregate liability relating to the service will not exceed the greater of S$100 or the fees you paid to TRAXAU in the 12 months before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or other liability that cannot lawfully be limited.

Suspension and termination

You may stop using TRAXAU and cancel your subscription at any time. We may suspend or terminate access where reasonably necessary to address security risk, unlawful use, material breach, unpaid fees, unsupported jurisdiction, provider requirements or harm to users or the service. Where appropriate, we will give notice and a chance to remedy.

Provisions that by nature should survive termination continue, including ownership, payment obligations already incurred, disclaimers, liability limits and dispute terms.

Singapore law and disputes

These Terms are governed by Singapore law. Subject to rights that cannot be waived, the courts of Singapore have exclusive jurisdiction. Before filing a claim, each party should give the other written notice and allow 30 days to try to resolve the dispute in good faith.

If you are a consumer, mandatory protections available to you under applicable consumer law, including Singapore's Consumer Protection (Fair Trading) Act 2003, are not excluded or restricted by these Terms.

Changes to these Terms

We may update these Terms to reflect service, legal or operational changes. We will post the updated version and date here. If a change materially affects an active paid subscription, we will provide additional notice where required. Continuing to use the service after the effective date means you accept the revised Terms; if you do not agree, stop using the service and cancel before the next renewal.
